PROBATE
"Probate" is the court proceeding
through which a Last Will and Testament (if any) is proved to be valid and the
last wishes of the decedent are followed. The attorney works closely with the
court appointed Personal Representative (Executor) in collecting and marshaling
the assets of the decedent, ascertaining and liquidating decedent's
liabilities, paying necessary State and Federal taxes, if any, and distribution
of the remaining assets subject to this administration to the persons and/or
entities so entitled.
